Promoter: Diageo Ireland with registered address St James's Gate, Dublin, 8 Ireland (Company No. 22876)
These are the terms and conditions applicable to persons ("You" or the "Artist") entering the GUINNESS ON-TRADE PROMOTION, "OUR THURSDAYS" (the "Promotion"). The Promotion will run in trade outlets ("Outlet(s)") in the Republic of Ireland and Northern Ireland between July 15th 2010 and September 23rd 2010. The ultimate prize (the "Prize") is for the winning emerging artist or band to play on stage at the Hopstore as part of the Arthur's Day celebrations on Thursday 23rd September 2010. Two runners up will play as part of the line up at a Studio venue in Galway or Cork; with a further 100 Artists playing in their local outlet on Arthur's Day.
By entering the Promotion, You accept these terms and conditions and agree to be bound by them.
- Eligibility
- This Promotion is only open to residents of the Republic of Ireland and Northern Ireland.
- Entrants must be 18 years or over at time of registration and must be able to show proof of age upon entry and as required.
- Employees, representatives and agents of Diageo plc or any of its associated or affiliated companies, their immediate families or any person domiciled with them, or any person professionally involved in this Promotion are not eligible to enter.
- In the event a successful applicant fails to comply with or meet any of the terms or requirements contained in these terms and conditions, any selection of his/her entry as a winning entry will be deemed void and the Promoter may, at its absolute discretion, award the relevant prize to a reserve.
- Entry
- There is no purchase necessary to enter the Promotion and a purchase will not increase an entrant's chance of winning.
- Entry is via online submission and entrants must fulfil the entry criteria in full to be accepted onto the shortlist. Full entry details can be found on www.guinness.com/arthursday or in Outlet. During the entry process you must accept these terms and conditions.
- Entry date is June 3rd at 9am and the closing date for entries is July 12th at 8am. No entries after this date will be accepted.
- You may enter the Promotion only if you have a telephone number and email address of your own or you can provide details of a telephone number through which you can be easily contacted.
- Notification of Successful Applicants
- Successful applicants will be contacted in the first instance by telephone or email. The Promoter will use reasonable endeavours to contact the successful applicant, but in the event that said applicant cannot be reached by telephone, SMS or email within seven days, the Promoter will move to the first priority on the shortlist.
- Names of the successful applicants will be publicly disclosed within 4 weeks of the selection process. This list will be available on www.guinness.com.
- Successful applicants are obliged to inform the Promoter as soon as practical if they are unable to participate in the Promotion for any reason.
- The Promoter reserves the right to amend or withdraw this Promotion or any of the Prizes or to amend these terms and conditions without notice in the event of any unforeseen circumstances outside its reasonable control. Any changes will be posted at www.guinness.com.
- The Promoter reserves the right to disqualify any Artist if it has reasonable grounds to believe the Artist has breached any of these terms and conditions.
- In the event of any dispute regarding the conduct or results of the Promotion, these terms and conditions or any other matters relating to the Promotion; the decision of the Promoter shall be final and no correspondence or discussion shall be entered into.
- Performances
- The 4x regional showcases will run from 17:00 to 23:00 dependent on location and Outlet trading hours. Exact scheduling of bands TBC.
- If you are a resident of Galway, entrants must be available to perform on either 15th July, 22nd July or 5th August. Artists who make it through to the final pub showcase must be available to perform on 12th August.
- If you are a resident of Northern Ireland, entrants must be available to perform on either 22nd July, 29th July or 5th August. Artists who make it through to the final pub showcase must be available to perform on 12th August.
- If you are a resident of ROI (excluding Galway), entrants must be available to perform on either 15th July, 22nd July or 29th July. Artists who make it through to the final pub showcase must be available to perform on 5th August.
- Artists who qualify for the regional and national showcases must be available to perform on 26th August and 2nd September.
- Winning Artists from the 100 participating pubs must be available to play at that venue on Arthur’s Day, 23rd September. The 3 Artists who go through from the 2nd Sept final will play as part of the main line up on Arthur’s Day in Dublin, Cork or Galway. These 3 Artists will be replaced at their pub venue by their runners up.
- The Promoter has the right to change dates, venues and times of all performances on short notice to the Artist (within reason)
- Artists agree to perform for no fee at all stages of Our Thursday showcases up to and including Arthur's Day.
- The Artist will be solely responsible for their own transportation to and from the event.
- For the national and 4 regional showcases travel and expenses will be covered to a maximum of €500 per band (to include entourage)
- Any Artist participating at any Our Thursday showcase, consents to be included in any filming, photography and sound recording at the event for use by Diageo and broadcast by third parties as required (including all Guinness websites and Guinness Ireland Facebook page). This includes any filming, photography or sound recording of your band, either on or off stage. By entering the Promotion, you agree to the use of your name, image and likeness by the Promoter for such publicity purposes.
- The use of cameras, videos or recording equipment is strictly prohibited at the event, without prior consent.
- If any images from Our Thursday are required by the Artist or anyone associated with the Artist, for example, for use in publicity materials, in the press or on websites, these images must be provided and approved by Freud Communications or their nominated representative.
- No illegal substances are to be brought onto a participating Outlet at anytime
- Any participating Artist who is intoxicated or demonstrating behaviour likely to cause damage, injury, nuisance or annoyance, will be refused admission to the Our Thursday showcases, regional showcases and the national showcase.
- Liability
- The Promoter and its agents accept no responsibility for difficulties experienced in submitting an entry to this Promotion. You agree that, to the extent permissible by law, the Promoter and its affiliates, agents and their employees, directors and shareholders assume no liability for injuries, losses or damages of any kind to property or persons, including without limitation death, resulting in whole or part directly or indirectly, from the management of or mechanics behind the Promotion, entry into the Promotion and acceptance of a Prize.
- Nothing shall exclude the Promoter's liability for death or personal injury as a result of its negligence.
These terms and conditions shall be governed by and construed in accordance with Irish law and subject to the exclusive jurisdiction of the Courts of Ireland.
An Artist's personal data will only be held for the purpose of contacting the Artist in relation to their participation in this Promotion and will not be used for any other purposes whatsoever without their prior permission.
